What is an Income Tax Return?

An Income Tax Return (ITR) is the annual statement of your income, deductions, and taxes paid that you file with the Income Tax Department of India. Filing the correct ITR form on time confirms your tax position for the financial year, lets you claim refunds of excess TDS, carry forward losses, and serves as proof of income for loans, visas, and tenders. For FY 2025-26 (Assessment Year 2026-27) the new tax regime is the default, with income up to ₹12 lakh effectively tax-free for resident individuals after the Section 87A rebate. Anyone whose income exceeds the basic exemption limit — or who meets any mandatory-filing condition — must file an ITR, even when no tax is payable.

Who Should File an ITR?

You should file an income tax return if any of the following apply to you:

  • Total income (before deductions) exceeds the basic exemption limit

Penalties for Late or Non-Filing

What is an Income Tax Return (ITR) and who needs to file it?+
An ITR is the annual statement of your income and taxes filed with the Income Tax Department. You must file if your total income before deductions exceeds the basic exemption limit. Filing is also mandatory regardless of income if you hold foreign assets or income, have deposited large sums in bank accounts, spent over ₹2 lakh on foreign travel, paid electricity bills over ₹1 lakh, or had TDS/TCS above the prescribed threshold. Many people also file voluntarily to claim refunds or to build proof of income for loans and visas.
Which ITR form applies to me?+
It depends on your income sources. ITR-1 (Sahaj) suits most salaried individuals with income up to ₹50 lakh; ITR-2 covers capital gains, multiple properties, or foreign assets; ITR-3 is for business or professional income; ITR-4 (Sugam) is the presumptive-taxation form for small businesses and professionals; ITR-5, ITR-6, and ITR-7 are for firms/LLPs, companies, and trusts respectively. What is the due date for filing my ITR?+
For most individuals and taxpayers not requiring an audit, the due date is 31st July following the financial year. For taxpayers whose accounts must be audited, it is 31st October, and 30th November where a transfer-pricing report is required. Dates are occasionally extended by the CBDT — we track this for you.
Is income up to ₹12 lakh really tax-free now?+
Under the new tax regime for FY 2025-26 (AY 2026-27), resident individuals with total income up to ₹12 lakh pay no tax after the Section 87A rebate. Salaried taxpayers also get a ₹75,000 standard deduction, raising the effective tax-free salary to about ₹12.75 lakh. You must still file an ITR if your income exceeds the basic exemption limit, even when the rebate brings your tax to nil.
What happens if I miss the deadline?+
You can still file a belated return up to 31st December of the assessment year, but with a late fee under Section 234F (up to ₹5,000, reduced to ₹1,000 if total income is below ₹5 lakh) plus interest on any unpaid tax. Late filing also blocks you from carrying forward most losses. We help you file on time to avoid these costs.
Can I still file if I've missed even the belated deadline?+
Yes — an Updated Return (ITR-U) can be filed up to 48 months (4 years) from the end of the relevant assessment year, subject to additional tax. It cannot be used to claim a refund or reduce tax, but it lets you regularise missed income and stay compliant.
Do I need to choose between the old and new tax regime?+
The new regime is the default, but the old regime (with deductions like 80C, 80D, and HRA) can still be better if you have significant investments and exemptions. Our CA computes your tax under both and files under whichever is lower — a key part of every Golden Verdict ITR.

What is the difference between the old and new tax regimes?+
The new regime offers lower slab rates but removes most deductions and exemptions (like 80C, 80D, and HRA). The old regime has higher rates but lets you claim those deductions. The new regime is the default — but if you have significant investments, insurance, or rent, the old regime can still work out cheaper. We compute both and file under the lower one.
What is Form 16 and do I need it to file?+
Form 16 is the TDS certificate your employer issues, summarising your salary and the tax deducted. It makes salary filing straightforward, but it isn't strictly mandatory — we can also prepare your return from salary slips and Form 26AS if Form 16 isn't available.
I changed jobs during the year and have two Form 16s. What should I do?+
Share both. We consolidate income from all employers, account for any double-counted exemptions or deductions, and recompute your correct tax — a common area where self-filed returns go wrong and attract demand notices.
What is the difference between Form 26AS and AIS?+
Form 26AS is a consolidated statement of tax deducted/collected and tax paid against your PAN. The Annual Information Statement (AIS) is broader — it also reports interest, dividends, securities transactions, and more. We reconcile your return against both so reported income matches the department's records.
How are capital gains taxed?+
It depends on the asset and holding period. Listed equity and equity mutual funds held over 12 months are long-term; gains above ₹1.25 lakh are taxed at 12.5%, while short-term gains are taxed at 20%. Property and debt instruments have their own rules. Our CA computes gains with the correct holding periods, indexation where applicable, and exemptions like Section 54.
How is income from crypto / virtual digital assets taxed?+
Gains from virtual digital assets (crypto, NFTs) are taxed at a flat 30% plus cess, with no deduction except cost of acquisition and no set-off of losses. A 1% TDS also applies on transfers. We report VDA income correctly in your ITR to avoid mismatches with exchange-reported data.
Can both HRA and home loan benefits be claimed together?+
Yes, in genuine cases — for example, if you rent in your work city while repaying a home loan on a property elsewhere (or one that's let out). The claim must be bona fide; our CA reviews your situation to claim both correctly where eligible.
Do freelancers and consultants need to pay advance tax?+
Yes. If your total tax liability for the year exceeds ₹10,000, advance tax is payable in instalments through the year. We help you estimate and plan advance tax so you avoid interest under Sections 234B and 234C.

How long does it take to receive my refund?+
Once your return is filed and e-verified, refunds are usually processed by the Income Tax Department within a few weeks, credited directly to your pre-validated bank account. We help pre-validate your account and track the refund status for you.
Should I file a return even if my income is below the exemption limit?+
It's often worth it. A 'nil' return helps you claim TDS refunds, builds a documented income history for loans and visas, and lets you carry forward certain losses. In some cases (foreign assets, high-value transactions) filing is mandatory regardless of income.
Do NRIs and people with foreign income need to file in India?+
NRIs must file if their India-sourced income exceeds the basic exemption limit or to claim refunds. Residents with foreign income or assets must disclose them and can claim foreign tax credit under a DTAA using Form 67. We handle residential-status determination and foreign-income reporting.
