What is Trademark Renewal?

A registered trademark in India is valid for 10 years from the date of application (not the date of registration). Before the expiry date, the trademark owner must file Form TM-R (Application for Renewal) and pay the renewal government fee (₹10,000 per class for e-filing). The renewal extends the mark's validity for another 10 years. If the renewal is not filed before the expiry, the mark enters a 6-month grace period (with a surcharge). Failure to renew within the grace period results in removal of the mark from the Register — allowing any third party to file an identical mark. Renewal is perpetual — a trademark can be renewed indefinitely, and many iconic brand trademarks are decades old.

When should I file a trademark renewal?+
The trademark renewal can be filed any time within 1 year before the expiry date. The Trade Marks Registry also sends a reminder notice. If missed, a 6-month surcharge-bearing grace period follows expiry. We recommend filing at least 6 months before expiry to avoid any administrative delays.
What is the government fee for trademark renewal?+
₹10,000 per class for e-filing (₹11,000 for physical filing) — same government fee as the original application. If filing in the 6-month grace period after expiry, an additional surcharge of 50% (₹5,000 per class) applies. Our professional fee of ₹1,999 is separate.
Can a trademark be renewed if it has not been used?+
Yes — a trademark can be renewed regardless of whether it is being actively used. However, a trademark that has not been used for 5 consecutive years after registration can be cancelled by a third party on grounds of non-use under Section 47 of the Trade Marks Act. Renewal does not prevent a non-use cancellation action.
What happens if a trademark lapses (not renewed in grace period)?+
If the mark lapses, it is removed from the Register. Any third party can then file an application for the same or similar mark. There is no absolute right to restore a lapsed mark — the proprietor would have to file a new application and may face opposition from third parties who applied during the lapse period.
Can I modify the goods/services specification at renewal?+
No. Renewal must be for the same specification as originally registered. If you want to add goods/services, a new trademark application must be filed for the new specification. However, you can reduce the specification at renewal (remove goods/services you no longer use).
