What is a Patent?

A patent is a statutory right granted by the government to an inventor, giving them the exclusive right to make, use, sell, import, or export the patented invention for a period of 20 years from the date of filing. To be patentable, an invention must be: novel (not disclosed in prior art), inventive (not obvious to a person skilled in the art), and capable of industrial application. The Indian Patent Office (IPO) grants patents under the Patents Act, 1970. The patent prosecution process involves filing the complete specification and claims, requesting examination, responding to the First Examination Report (FER), and attending a hearing if required. The average prosecution time in India is 3–5 years from filing to grant.

Patent Prosecution Stages

Complete Specification Drafting:

Full technical description of the invention, enablement, and best mode. Strategically drafted independent and dependent claims defining the scope of protection.

Form 2 Filing — Indian Patent Office:

Application for Grant of Patent with complete specification, abstract, drawings, and applicant details filed with the appropriate IPO branch (Delhi, Mumbai, Chennai, or Kolkata).

Publication:

Applications are published in the Official Patent Journal 18 months from the priority/filing date. Early publication can be requested for faster prosecution timeline.

Request for Examination (Form 18):

Must be filed within 48 months of priority date. This triggers substantive examination of the application. Expedited examination is available for startups and DPIIT-recognised entities.

First Examination Report (FER) Response:

Patent Examiner issues objections (novelty, inventiveness, clarity, enablement). Our attorneys draft and file a detailed response with claim amendments and arguments.

Grant:

What types of inventions can be patented in India?+
Any new product or process that involves an inventive step and is capable of industrial application. This includes: mechanical inventions, chemical compositions, pharmaceutical compounds, biotechnology, software inventions (with technical character/effect), and business method inventions. Excluded are: abstract ideas, mathematical methods, mental acts, discoveries, scientific theories, and inventions that are commercially unethical.
What is the government fee for patent filing?+
Government fees (e-filing) for Complete Specification (Form 2): Natural person/startup/SME — ₹1,600; Small entity — ₹4,000; Other entity (company) — ₹8,000. Request for Examination (Form 18): ₹4,000 (natural person) / ₹10,000 (company). Annual renewal fees also apply from year 3 onwards.
What is a First Examination Report (FER)?+
After the Request for Examination is filed and the application is taken up for examination (typically 3–4 years later), the Patent Office issues a First Examination Report (FER) with objections. The applicant has 12 months to file a reply addressing all objections with amended claims or arguments. Our attorneys handle the complete FER response.
Can I file a PCT (International) Patent Application?+
Yes. A PCT (Patent Cooperation Treaty) application through WIPO allows you to file a single international application that can enter the national phase in up to 150+ member countries within 30 months of the priority date. What is the patent term and renewal requirement?+
Indian patents are granted for 20 years from the filing date of the complete specification. Annual renewal fees must be paid starting from the 3rd year (Form 4 — Request for Grant of Patent) to maintain the patent in force. Failure to pay renewal fees results in the patent being treated as ceased.
