What is Copyright Registration?

Copyright subsists automatically in an original work from the moment it is created and fixed in a tangible form — registration is not required for copyright to exist. However, registration with the Copyright Office (under the Copyright Act, 1957) creates a public record of ownership, provides prima facie evidence of validity in legal proceedings, and is required before filing an infringement suit for statutory damages. The Copyright Office maintains a Register of Copyrights where applicants can register literary works (books, articles, code), artistic works (paintings, logos, photographs), musical works, sound recordings, cinematographic films, and computer programmes. Registration involves filing an application with the prescribed government fee, submitting copies of the work, and a 30-day public objection period before registration.

Types of Works We Register

Literary Works:

Books, articles, screenplays, song lyrics, poetry, databases, websites, and software/computer programmes. Classification as 'literary works' applies to all written expression.

Artistic Works:

Paintings, drawings, sculptures, photographs, logos, illustrations, architectural drawings, and maps — regardless of artistic quality.

Musical Works:

Musical compositions with or without words — the notation or recording of the music. Separate from sound recordings (which are the actual recorded performance).

Cinematographic Films:

Films, web series, advertisements, documentaries, and any visual recording — including the work as a whole and individual elements within it.

Computer Programmes:

Software source code and object code registered as literary works. Includes mobile apps, web applications, databases, and proprietary algorithms.

Can I register copyright in software/source code?+
Yes. Computer programmes are classified as 'literary works' under the Copyright Act, 1957. Software can be registered with the Copyright Office. However, the deposit copy (submitted with the application) becomes part of the public record — we advise on depositing only a sanitised version to protect trade secrets.
