What is a Provisional Patent Application?

A Provisional Patent Application (under Section 9(1) of the Patents Act, 1970) allows an inventor to establish an early priority date without submitting a complete specification. The provisional specification describes the invention in sufficient detail to establish the priority date but does not need to include all claims. After filing the provisional application, the inventor has 12 months to file the Complete Specification (Form 2) before the patent application lapses.
