Why Property Registration is Mandatory

Under the Registration Act, 1908 and the Transfer of Property Act, 1882, any transaction involving immovable property (sale, gift, exchange, mortgage, or lease for over 12 months) must be registered with the Sub-Registrar of Assurances in whose jurisdiction the property is located. An unregistered sale deed has no legal validity and cannot be used as evidence in a court of law — the title does not pass to the buyer without registration. Registration involves payment of stamp duty (calculated on the market value or circle rate, whichever is higher) and registration charges (typically 1% of the property value). State governments have introduced e-registration systems to streamline the process.

What documents are required for property registration?+
Original title documents (previous sale deed, municipal property card, survey records), identity proof (Aadhaar/PAN) of buyer and seller, two witnesses with identity proof, property card or 7/12 extract (in Maharashtra), encumbrance certificate (in South India), and No Objection Certificate from housing society if applicable.
How is stamp duty calculated?+
Stamp duty is calculated on the higher of the agreed transaction value or the government circle rate (ready reckoner rate) for the locality. Rates vary by state — Maharashtra: 6% (5% + 1% metro cess + 1% LBT in some areas); Karnataka: 5.6%; Delhi: 6% (men)/4% (women). Registration charges are typically 1% of property value.
What is an Encumbrance Certificate?+
An Encumbrance Certificate (EC) is issued by the Sub-Registrar's office and lists all registered transactions on a property — mortgages, liens, sale deeds, and charges. A clean EC confirms the property is free of registered encumbrances. It is a critical document for property due diligence.
What is e-registration?+
Many states (Maharashtra, Karnataka, Telangana, etc.) now offer e-registration through their state portals. The sale deed is prepared and submitted online, stamp duty is paid digitally, and the registration appointment at the sub-registrar office is booked online. Physical presence at the SRO is still required for biometric verification.
What is property mutation and is it separate from registration?+
Yes. Registration transfers legal title. Mutation (Naam Kharij/Dakhil Kharij) updates the municipal/revenue records to reflect the new owner's name for property tax purposes. Mutation must be applied separately after registration. We assist with mutation applications as well.
