Is registration of a Will compulsory in India?+

No. Registration of a Will is not compulsory under Indian law. An unregistered Will that is properly executed and attested is legally valid, though registration with the Sub-Registrar can provide additional evidentiary value and reduce the risk of tampering or disputes.

How many witnesses are required to sign a Will?+

Generally, two independent adult witnesses are required to attest the Will. They should witness the Testator signing or acknowledging the Will and then sign in the presence of the Testator and each other. Beneficiaries should ideally not act as witnesses to avoid disputes.

Can I change this Will later if my circumstances change?+

Yes. You can change your Will any time while you are of sound mind by executing a new Will or by making a codicil. It is good practice to clearly revoke earlier Wills and to sign the new Will with fresh witnesses.

What happens if I do not include a residuary estate clause?+

If you omit a residuary clause, any assets not specifically covered in your Will may devolve as per intestate succession rules under your personal law, potentially leading to unintended shares or disputes. A residuary clause ensures that all remaining property is covered.
