What is the Madrid Protocol?

The Madrid Protocol is an international treaty administered by the World Intellectual Property Organization (WIPO) that allows trademark owners to seek protection in multiple countries through a single 'international application' filed through their home country's trademark office. India joined the Madrid Protocol in 2013. An Indian trademark applicant or owner can file an international application through the Trade Marks Registry of India (as the Office of Origin), designating protection in any or all of the 130+ Madrid System member countries. The international registration is based on the home (Indian) application or registration — it receives the same filing date. Each designated country's national trademark office then examines the application under its own laws.

What is the advantage of the Madrid System over national filings?+
A single international application covers up to 130+ countries in one filing, in one language (English, French, or Spanish), with one set of fees paid to WIPO. Managing the portfolio is centralised through WIPO. Without Madrid, each country requires a separate national application through local agents — significantly more expensive and complex.
What is the WIPO fee structure?+
WIPO fees consist of a basic fee (CHF 653 for B&W mark / CHF 903 for colour) plus supplementary fees for each additional class above 3 (CHF 100/class) plus individual fees for certain countries (US, EU, Japan, China) that charge additional examination fees. What happens in each designated country?+
Each designated country's trademark office has 12 months (or 18 months for countries that declared this option) to issue a provisional refusal on national grounds. If no refusal is issued within the deadline, the mark is automatically protected in that country. Golden Verdict monitors all deadlines and responds to national-phase refusals.
What is the 5-year dependency period?+
An international registration depends on the base (Indian) application or registration for its first 5 years. If the Indian base mark is rejected or cancelled during this period, the international registration ceases. After 5 years, the international registration becomes independent of the base mark.
