The Food Safety and Standards Authority of India (FSSAI) regulates all food businesses under the Food Safety and Standards Act, 2006. Every Food Business Operator (FBO) — from a petty street vendor to a large food manufacturer — must obtain an FSSAI licence or registration before commencing operations. There are three categories: Basic Registration (turnover below ₹12 lakh/year), State Licence (turnover ₹12 lakh to ₹20 crore/year or certain food categories), and Central Licence (turnover above ₹20 crore/year, importers, exporters, or pan-India operations). Operating without an FSSAI licence invites penalties up to ₹5 lakh and criminal prosecution under the Food Safety Act.
Basic Registration (Form A):
For petty food businesses with annual turnover below ₹12 lakh. Includes hawkers, small vendors, cottage industries, and home bakers selling locally. Government fee: ₹100/year.
State Licence (Form B — State):
For food businesses with annual turnover ₹12 lakh to ₹20 crore, restaurants, dhabas, food manufacturers, retailers, and distributors operating within a single state.
Central Licence (Form B — Central):
For importers, exporters, businesses with turnover above ₹20 crore, or those operating across multiple states. Required for large manufacturers, cold storage operators, and dairy processing units.
Basic Registration
Aadhaar card / PAN, passport-size photo, premises address proof (electricity/water bill), nature of food business declaration
State Licence
Photo ID and address proof of FBO, business entity proof (GST/incorporation), premises rent/ownership deed, list of food products, food safety management plan, water test report
Central Licence
All State Licence documents + blueprint of manufacturing unit, list of machinery & equipment, source of raw material, IE code (for importers/exporters), MOA/AOA for companies
No FSSAI licence:
Penalty up to ₹5 lakh under Section 55 of the Food Safety and Standards Act, 2006. Court may also order closure of premises.
Expired FSSAI licence:
Operating with an expired licence is treated as operating without one. Late renewal also attracts a penalty of ₹100/day from the date of expiry.
Selling unsafe food:
Penalties up to ₹5 lakh for sub-standard food. Imprisonment up to 6 months + ₹1 lakh fine for unsafe food. Up to life imprisonment for adulterating food causing grievous hurt.
Non-display of licence:
FSSAI certificate must be displayed prominently at the business premises. Failure to display invites a penalty of ₹2,000 per offence.
Renewal window
Apply for renewal at least 30 days before expiry. FSSAI licences can be renewed for 1–5 years; renewal application mirrors the fresh application process.
Annual Return (Form D1)
All State and Central licence holders must file FSSAI Annual Return (Form D1) by 31 May each year, covering food products handled, quantity, and turnover during the preceding financial year.
Half-yearly return (Form D2)
Milk and milk product businesses must additionally file a half-yearly return (Form D2) — by 31 October for April–September and by 30 April for October–March.
Amendment obligation
Any change in premises, food category, FBO name, or business structure must be notified to FSSAI within 30 days via a licence amendment application.
