Copyright Infringement Under Indian Law

Copyright infringement under the Copyright Act, 1957 occurs when a person does any of the acts reserved exclusively for the copyright owner — without licence or legal justification. Infringing acts include: reproducing a work in any material form, issuing copies to the public, performing the work in public, broadcasting or communicating to the public, making adaptations, or storing the work digitally. Section 51 defines infringement, and Section 55 provides civil remedies: injunction (including ex-parte), damages or account of profits, and delivery up/destruction of infringing copies. Sections 63–70 provide criminal remedies: imprisonment of 6 months to 3 years and fines of ₹50,000 to ₹2 lakh for first offences (enhanced for repeat offences). Online infringement is addressed through Section 52(1)(b) — Internet Service Providers and platforms have safe harbour obligations and must take down infringing content on notice.
